Members’ Liability & Personal Accident Insurance

All those involved in sport, in whatever capacity, must ensure that anything they do does not cause injury or loss to other people, or damage to property. If they do they could be legally liable to pay damages, as awarded in a civil court.   The sport of shooting is no exception.
 
In order to safeguard the sport the CPSA has arranged a unique “Civil Liability” insurance. It automatically protects all full and clubman members; CPSA qualified coaches (who are full CPSA members), and CPSA qualified safety officers and referees (who are full or clubman members); regional and county officials, committee members and volunteers.
 
A summary of this insurance cover is as follows:
 
CIVIL LIABILITY PROTECTION
 
Most important, the policy includes indemnity for a CPSA member who causes injury or financial loss to another person, or damage to third party property (commonly known as Public Liability), whilst taking part in a CPSA recognised activity.
 
Other examples include:
 
· Professional Indemnity – liability for advice given
· Libel & Slander – liability for written and spoken word eg instructional/marketing material
· Indemnity for county officials/regional committees in respect of their executive responsibilities
 
All activities recognised and approved by the CPSA are covered. These include:
 

·  Clay target shooting
·  Game shooting
·  Rough shooting
·  Vermin control
·  Wild fowling
Plus:
· Rifle shooting (including stalking)
· Hunting (including falconry)
· Angling (including wading)
· Beating
 
Cover excludes:
· Combat/practical shooting
· Equestrian mounted sports
· Sea/lake/river/reservoir/estuary fishing from a boat/ship etc

 
Limit of indemnity: Civil Liability £10,000,000 any one occurrence
(in the aggregate in respect of Products Liability, Directors & Officers and Abuse cover)
 
·          There is no policy excess
·          Cover is worldwide, subject to prior declaration of visits to USA/Canada
·          THERE IS NO UPPER AGE LIMIT
 

Principal exclusions
Liability arising out of:
·    Criminal acts of the insured
·    Ownership or use of any vehicle, aircraft, hovercraft or water-borne craft
·    Loss of or damage to your own property
·    Product guarantee or recall, repair or replacement
·    Medical malpractice
·    Fines, penalties, punitive or exemplary damages
·    The person accused of abuse/alleged to be the abuser

PERSONAL ACCIDENT BENEFITS
 
Personal Accident (no fault compensation) benefits are also available to all members whilst participating in a CPSA authorised or recognised activity anywhere in the world (including direct travel to and from events within the UK).
 
It is available to members (between the age of 10 and 80) who are injured whilst participating in all legal and recreational shotgun sports, including:
 

· Clay target shooting
· Game shooting
· Rough shooting
· Vermin control
· Wild fowling
Plus:
· Rifle shooting (including stalking)
· Hunting (including falconry)
· Angling (including wading)
· Beating
 
Cover excludes:
· Combat/practical shooting      
· Equestrian mounted sports
· Sea/lake/river/reservoir/estuary fishing from a boat/ship etc

 
Benefits are as follows:
 

Up to age 75 except where stated
Death (up to aged 80)                                                                                               £20,000

Permanent and total loss of speech                                                 £20,000

Permanent total disablement from any gainful employment or gainful occupation for which the

Emergency dental expenses, if external oral impact results in damage to a members’ teeth

Replacement spectacles, if there is a valid claim under the accident section                                £250

 

Principal exclusions
·    Taking a drug unless it is taken on proper medical advice
·    War or terrorism
·    Illness or disease not resulting from bodily injury or bodily injury due to any gradually operating cause

OTHER INFORMATION
 
Important notes – civil liability

1.     Cover extends for the period of your paid subscription, subject to the main policy being renewed. Full details of the policy terms and conditions are available on request. This certificate should in no way be taken as a substitute for the full membership policy. 

2.     The Civil Liability policy is written on a claims made basis. This means that the policy which responds, is the one that is in place when a claim is actually made, not the one in place when the incident occurred.

3.     It is essential that you (or a representative of your club or the ground where you shoot) report every incident that could give rise to a possible claim to the CPSA’s insurance brokers, Perkins Slade Ltd. In addition an accident record book should be maintained keeping accurate records of the date and time any incident occurs, along with details of all relevant circumstances and the full name and address of any parties involved including witnesses.

4.     Any letter, claim, writ, summons or process in connection with an incident (involving a member) must be forwarded to Perkins Slade without delay.

5.     It should be noted that it is a condition of the Civil Liability policy that under no circumstances should any offer or promise of payment be made by, or on behalf of, an insured person.

6.     What to do in the event of a claim:
(a)    Do not admit liability
(b)    Contact Perkins Slade - Claims Dept (0121 698 8050) for a claim form and complete it as necessary
(c)    Forward all correspondence unanswered to Perkins Slade who will handle the response on your behalf and provide any guidance to you

(d)   It will be necessary for Perkins Slade to confirm you are an affiliated member of the CPSA, therefore, please have your membership number to hand so we can complete this check as quickly as possible.
